TERMS

A 10% non-refundable earnest money deposit shall be due on the day of the auction or delivered within three (3) business days to the designated closing attorney or escrow agent. Earnest money will be held in escrow until closing.

This shall be a reserve auction. The seller reserves the right to accept or reject any and all bids. The seller may, at the seller’s sole discretion, lift the reserve during or after the auction, at which time the property will sell to the highest bidder subject to seller confirmation.

Only approved bidders shall be permitted to bid. Prospective bidders may be required to provide proof of funds or a letter of credit prior to bidding approval.

The property is being sold on a price per acre basis based upon surveyed acres. The final purchase price shall be determined by multiplying the final surveyed acres by the successful bid price. 

The property is being sold “AS IS, WHERE IS” with no warranties or guarantees, expressed or implied, made by the seller or auction company.

There shall be no financing contingencies. The successful bidder shall enter into a purchase agreement immediately following the auction.

Closing shall occur on or before September 18, 2026, subject to merchantable title. Real estate taxes shall be prorated to the date of closing. Possession shall be granted at closing, subject to any current lease agreements, if applicable.

All announcements made on the day of the auction shall take precedence over any previously printed or advertised material.
